DOJ Abandons Effort to Overturn Industry's Win (11/10/2025)

On June 6, 2025, the United States’ Petition for Rehearing En Banc was denied by the U.S. Court of Appeals for the Federal Circuit (Court of Appeals). This ruling left the United States government with only one final avenue to appeal the industry’s historic win that held that the U.S. Centers for Disease Control and Prevention’s (CDC) eviction moratorium was an illegal taking under the United States Constitution: An Appeal to the Supreme Court of the United States (SCOTUS). On August 25, 2025, the United States appeared inclined to do just that, filing an Application with SCOTUS to extend the time to file a petition for a writ of certiorari from September 4 to October 3. On August 29, this Application was granted by Chief Justice Roberts – in addition to a second Application that ultimately extended the filing deadline to November 3.

Greystar Reaches Agreement with U.S. Department of Justice and Private Class Action Plaintiffs

Charleston, SC – August 8, 2025 – Greystar Management Services, LLC ("Greystar") has reached an agreement with the U.S. Department of Justice (DOJ) to resolve DOJ’s claims about Greystar’s use of RealPage's revenue management software. Greystar has also reached an agreement in principle to settle a lawsuit brought by a nationwide class of renters alleging similar claims (In re: RealPage, Inc., Rental Software Antitrust Litigation).
 
Greystar firmly believes that its use of RealPage's revenue management software complies with all applicable laws. That is why Greystar has vigorously defended itself in these matters and will continue to defend itself against any claims brought by regulators. Today's settlements do not change that belief and the settlements contain no admission of wrongdoing.

Federal Lands: In March, U.S. Department of Housing and Urban Development (HUD) Secretary Scott Turner and U.S. Department of the Interior (DOI) Secretary Doug Burgum announced the Joint Task Force on Federal Land for Housing. The Task Force aims to find federal land vacancies that can be used for new affordable housing units, assisting with land transfer operations, streamlining regulations and increasing awareness for the urgent need for more housing.
