Understanding FCC's Latest Multifamily Broadband Rules

On February 15, 2022, the Federal Communications Commission adopted rules that impose the following regulations on housing provider-telecommunication services provider relationships:

1. Prohibit telecommunication services providers from entering into contracts with housing providers that contain exclusive and/or graduated revenue share agreements;

2. Require telecommunication services providers to disclose the presence of exclusive marketing arrangements to residents; and

3. Reaffirm the ban on sale-and-leaseback wiring practices.

These requirements went into effect on April 27, 2022 for new contracts and will take effect on September 26, 2022 for existing contracts.
